The Phase II Final rule requires an operator of a regulated small municipal separate storm sewer system (MS4), such as the City of Destin, to develop, implement and enforce a program to reduce pollutants in stormwater runoff to their MS4 from construction activities that result in a land disturbance of greater than or equal to one acre.
City of Destin Requirements
The City of Destin requires:
Adopting an ordinance or other regulatory mechanism requiring the implementation of proper erosion and sediment controls, and controls for other wastes, on applicable construction sites
Adopting sanctions to ensure compliance
Establishing procedures for the receipt and consideration of information submitted by the public
Implementing procedures for site inspection and enforcement of control measures
Implementing procedures for site plan review of construction plans that consider potential water quality impacts
Operators of construction activities must obtain NPDES stormwater permit coverage and implement pollution prevention techniques to minimize erosion and sedimentation and to properly manage stormwater.
